THEREFORE BE IT RESOLVED, that MACD opposes the legislation as currently written but would work toward finding an alternative acceptable to Montana Conservation Districts.

NOW THEREFORE BE IT FURTHER RESOLVED, that the Montana Association of Conservation Districts is directed to work with the necessary entities – including the Montana Department of Natural Resources and Conservation, Conservation District Bureau and/or the 2009 Legislative Assembly to clarify that the Natural Streambed and Land Preservation Act allows Conservation Districts to charge an inspection fee for administrative purposes.

NOW THEREFORE BE IT RESOLVED, that MACD and DEQ work together to set up a MOU or other process that can be tailored to fit individual districts.
NOW THEREFORE BE IT FURTHER RESOLVED, that cooperation shall include timely notification, inclusion of Conservation District’s Representatives in all field visits. Also included will be mutual sharing of all data, both CD and DEQ generated.

NOW THEREFORE BE IT RESOLVED, that transportation corridors are required in order to accommodate water users who need to move water for Agricultural and Municipal uses. MACD is directed to work with Montana Department of Transportation, Montana Department of Natural Resources and Conservation, Montana Department of Agriculture and other appropriate entities/agencies to alleviate problems with moving water through or under current road and rail ways and encourage the use of Montana’s waters for Agricultural and Municipal uses.

THEREFORE BE IT RESOLVED, that the Montana Association of Conservation Districts is directed to work with the necessary entities—including the Montana Department of Natural Resources and Conservation, Conservation District Bureau and/or the 2007 Legislative Assembly, if necessary—to clarify that the Natural Streambed and Land Preservation Act (SB-310 Law) allows Conservation to assess administrative penalties.
