THIS RESOLUTION DID NOT PASS AT GENERAL SESSION.
WHEREAS, the existing Natural Streambed and Land Preservation Act administrative process is free to all applicants; and
WHEREAS, the population is growing among urban counties across Montana, therefore, the work load is increasing for Conservation Districts to administer the Natural Streambed and Land Preservation Act; and
WHEREAS, the adoption of a set price for each Natural Streambed and Land Preservation Act application inspected by the Conservation District would benefit those districts with minimal mill levy funds.
NOW THEREFORE BE IT FURTHER RESOLVED, that the Montana Association of Conservation Districts is directed to work with the necessary entities – including the Montana Department of Natural Resources and Conservation, Conservation District Bureau and/or the 2009 Legislative Assembly to clarify that the Natural Streambed and Land Preservation Act allows Conservation Districts to charge an inspection fee for administrative purposes.
