WHEREAS, MACD adopted resolutions in 1988 and 1989 regarding ownerships of lands in streams and rivers, and

WHEREAS, rules regarding the administration of these lands and their determination do not seem to have been promulgated, and

WHEREAS, Montana’s Fish and Wildlife Conservation Strategy and the Montana draft conservation strategy for State Lands both raise significant questions regarding administration, ownership, and management of stream beds and banks that may belong to the state of Montana, and

WHEREAS, conservation districts administer Montana’s 310 act and management of stream beds and banks are of significant importance to conservation districts and

WHEREAS, the state of Montana has begun implementing a stream ownership plan with out promulgating the rules and with out participation contemplated in the 1988 and 1989 MACD resolutions, and these rules and participation in their creation and administration is desirable;

NOW THEREFORE BE IT RESOLVED, that MACD readopts resolution twenty-two from 1989, only changing Department of State Lands to Department of Natural Resources and Conservation.
